General Terms and Conditions of Sale

1. Introduction

These General Terms and Conditions of Sale (hereinafter referred to as "GTCS") define the rights and obligations of Madi Djimet (SP), a sole proprietorship registered under SIRET number 981 686 546 00012, head office located at 13 rue des Prés, 89400 Cheny, and any individual customer wishing to purchase the products offered on its website ameliemadi.com.

Madi Djimet offers for sale illustration prints. These GTCS apply to all orders placed by consumers on the ameliemadi.com website and govern the contractual relationship between the seller and the buyer.

All orders imply full acceptance of these terms and conditions.

2. Products and Ordering

2.1. Product characteristics

The products offered for sale on ameliemadi.com are illustration prints available in several formats: A4 and A5.

Prints are made on paper that may be glossy, matte or semi-gloss, depending on the illustration. The paper weight may also vary. More details on the characteristics of each product (dimensions, type of paper, materials, technique used, etc.) are indicated on the product sheet. Illustrations are presented as photos, and colors may vary slightly depending on monitors, their settings and lighting conditions.

Prints are made on demand, which means there is no stock in advance.

2.2. Ordering Process

The buyer can place an order on the website ameliemadi.com by following the steps below: Select the desired products and add them to the shopping cart, fill in the information required for delivery and invoicing, enter payment information, the buyer has the possibility to read the General Terms and Conditions of Sale (GTSC) before proceeding to payment. Then the buyer receives an order confirmation e-mail.

Any order is considered as final once payment has been validated.

3. Price and payment

3.1. Prices

Prices are in Euros (€), including all taxes (VAT), excluding shipping costs. Shipping costs are calculated and added to the total amount of the order before payment is validated.

As Madi Djimet is a company with the status of an artist-author not subject to VAT, no VAT is applicable in accordance with article 293 B of the French General Tax Code (CGI).

3.2. Payment terms

Orders may be paid by the following methods Credit card via Stripe. Other payment methods may be added in the future.

Payments are processed securely through Stripe, a payment service provider reknown for protecting online transactions. Madi Djimet never stores the buyer's banking information.

Payment is due immediately upon ordering. All transactions are secure.

Once payment has been confirmed, the buyer will receive an order confirmation by e-mail.

4. Delivery

4.1. Delivery Zones

Products are shipped in France, the European Union (EU) and internationally. Delivery costs and times vary according to destination. The buyer is responsible for any local customs and taxes, which are not included in the order price.

4.2. Shipping methods.

Orders are shipped exclusively by the French Postal Service, depending on the size and weight of the package. The exact delivery method will be specified when the order is placed. The buyer will receive a tracking number to follow the progress of his package, unless he chooses standard shipping without tracking.

4.3. Processing and shipping times

Prints are produced on demand and therefore require 1 to 5 business days for production before shipping. In addition, shipping times vary depending on the destination.

4.4. Delivery fees

Shipping costs are calculated based on the weight of the package and the delivery address. The amount will be displayed before the order is confirmed.

4.5. Delays and losses

Madi Djimet is not responsible for the delivery times applied by La Poste.

  • In the event of damage during transport, the buyer must file a claim directly with the carrier.

  • In the event of loss of the package, a refund will be made only if the post office or the carrier confirm the loss officially.

  • If the tracking of the package indicates that it has been delivered, no refund will be possible. Madi Djimet cannot be held responsible for any theft during shipping or delivery.

4.6. Packaging of the products

Products are carefully packaged to protect them during transportation. Madi Djimet uses appropriate packaging such as rigid cardboard envelopes, crystal paper or silk paper to ensure that the illustrations are well protected.

⚠️ Inspection upon receipt: It is the buyer's responsibility to check the condition of the package upon delivery. In the event of a damaged package, he/she must indicate it to the carrier and, if necessary, refuse the package. Madi Djimet cannot be held responsible for any damage caused by the carrier after delivery.

5. Right of Withdrawal and Return

5.1. Right of withdrawal

In accordance with article L.221-18 of the French Consumer Code, the buyer has a period of 14 days from the reception of the order to exercise his right of withdrawal, except in the exception cases provided for by law.

5.2. Exceptions to the right of withdrawal

The right of withdrawal does not apply to personalized products, in accordance with article L.221-28 of the French Consumer Code. Furthermore, since prints are produced on demand, they cannot be taken back or refunded, except in the event of a proven error from Madi Djimet (e.g.: product delivered does not match the order).

5.3. Return procedure

If a return is justified by an error in the preparation of the order, the buyer must contact Madi Djimet by email at ameliemadi.illustration@gmail.com, indicating the order number and providing photos of the product received. The cost of returning the product is at the expense of the customer.

5.4. Refunds

Upon receipt and verification of the return, a refund will be issued within 15 days to the payment method used for the purchase.

⚠️ Shipping charges are never refundable once the item has been shipped and a tracking number has been provided.

6. Liability and Warranties

6.1. Responsibility of Madi Djimet

Madi Djimet makes every effort to ensure the accuracy of the information presented on the site ameliemadi.com. However, typographical errors or inaccuracies in product descriptions may occur.

Because products are printed on demand, there may be slight variations in the cut that do not affect the overall quality of the product. These variations are not considered as defects and do not entitle the customer to a refund or exchange.

6.2. Legal warranties

In accordance with current legislation, products sold on ameliemadi.com benefit from:

  • The legal guarantee of conformity (articles L.217-4 et seq. of the Consumer Code): the buyer may request the repair or replacement of a product that does not correspond to the description.

  • The guarantee against hidden defects (article 1641 of the French Civil Code): the buyer can ask for a refund or a price reduction if a defect is found that makes the product unusable.

6.3. Complaints and warranty exclusions

Claims accepted: In case of blurred print, if the defect is proven after verification by Madi Djimet. The buyer must send an email to ameliemadi.illustration@gmail.com with photos of the product in question.

Warranty exclusions:

  • Slight variations in cutting due to print-on-demand.

  • Improper handling by the customer (e.g. folding, scratching, tearing, etc.)

  • Deterioration due to exposure to humidity or inappropriate conditions after receipt of the product.

In case of doubt, the buyer may contact Madi Djimet with any questions regarding product quality.

7. Intellectual property

All illustrations sold on ameliemadi.com are original artworks protected by copyright in accordance with the provisions of articles L.111-1 et seq. of the French Intellectual Property Code.

The purchase of a print does not confer any intellectual property rights on the image. The purchaser acquires only a physical medium for strictly personal use.

Any reproduction, modification, distribution, resale or exploitation of the illustrations, in any form, without the prior authorization of Madi Djimet is strictly prohibited.

Any unauthorized use may result in legal action.

8. Personal Data and Confidentiality

8.1. Data collected and use

As part of the order process on ameliemadi.com, some personal information is collected: First and last name, postal address, email address, payment information (managed by Stripe, a secure service provider). This information is necessary to: Process orders and deliveries and communicate with the customer when necessary.

8.2. Privacy

Customers' personal information is kept confidential and is never sold to third parties. It is stored securely and used only for the purposes strictly necessary to fulfill orders. Because payments are processed by Stripe, Madi Djimet never has access to customer banking information.

8.3. User Rights

In accordance with the General Data Protection Regulation (GDPR), customers have the following rights with respect to their data:

  • Right of access, rectification and deletion: upon simple email request to ameliemadi.illustration@gmail.com.

  • Right to refuse the processing of data: except where such data is necessary for the performance of the contract (e.g. order management).

9. Applicable Law and Disputes

9.1. Applicable law

These General Conditions of Sale are governed by French law.

9.2. Settlement of disputes

In the event of a dispute, an amicable solution will be preferred. The buyer undertakes to contact Madi Djimet by mail or email (ameliemadi.illustration@gmail.com) to try to find a solution before taking legal action. This attempt to find an amicable solution must be justified (e.g.: e-mail exchange, etc.).

9.3. Consumer mediation

In accordance with articles L.612-1 et seq. of the French Consumer Code, in the event of failure to reach an amicable settlement, the buyer may, free of charge, have recourse to a consumer conciliator to resolve the dispute.

9.4. Competent court

If no amicable solution or mediation is found to resolve the dispute, it will be submitted to the competent courts within the jurisdiction of the registered office of Madi Djimet.
